Deed Types
The right deed type depends on the nature of the transfer and the level of title protection required. Eastern Title will advise on the appropriate instrument for your transaction.
General Warranty Deed
Seller warrants title against all prior claims — not just those arising during their ownership. Standard for arm's-length sales. Provides maximum buyer protection and is required by most lenders.
Special Warranty Deed
Seller warrants only against claims arising during their period of ownership. Common in commercial transactions, REO sales, and estate conveyances where the grantor cannot warrant the full chain of title.
Quitclaim Deed
Transfers whatever interest the grantor holds with no title warranties. Used for transfers between family members, divorce settlements, LLC and trust conveyances, and removing a co-owner from title.
Corrective Deed
Re-records a prior deed to fix errors in the legal description, party names, or notarization. Required to clear a defect in the chain of title before a future sale or refinance can proceed.
